Минулої п’ятниці Приморський райсуд Одеси розглянув адміністративний протокол про вчинення корупційних дій головою Одеської обласної ради Анатолієм Урбанським і відмовився притягувати до відповідальності останнього. В принципі нічого не ординарного, якби не одне “але”. Своїм рішенням суддя Віктор Іванов ставить під сумнів засади запобігання корупції, на які погодилося українське суспільство після Революції Гідності.
Нагадаємо, в лютому співробітники управління захисту економіки Нацполіції при підтримці прокуратури вручили чиновнику протокол про вчинення корупційних дій. А саме, Урбанський в грудні 2015 року, як тільки очолив область, не попередив депутатів про конфлікт інтересів, і самостійно проголовував на сесії Одеської облради за встановлення собі ж “надбавки за особливий характер роботи та інтенсивність праці у розмірі 90% посадового окладу з урахуванням доплати за ранг; щомісячну премію в розмірі 60% посадового окладу за фактично відпрацьований час; матеріальну допомогу на оздоровлення і для вирішення соціально-побутових питань у розмірі середньомісячної заробітної плати”. Це, на нашу думку, призвело до порушення положень Закону “Про засади запобігання корупції”, прийнятого на Покрову 2014 року при ствердній підтримці громадськості.
Що мав зробити Урбанський голова ради, аби запобігти конфлікту інтересів відповідно до нового антикорупційного закону? Особисто та публічно заявити про конфлікт інтересів перед голосуванням під час засідання ради. Після такого оголошення, чиновник місцевого самоврядування має право взяти участь у прийнятті рішення, яке містить приватний інтерес, тобто проголосувати.
Чому публічне оголошення про конфлікт інтересів важливо для протидії корупції? Все просто. Окрім надбавок та премій, депутати активно голосують за виділення землі власним родинами, за розподіл бюджетних грошей на кишенькові організації чи за бонуси для власного бізнесу. Тому публічна заява щодо приватного інтересу перед голосуванням фактично є важливим елементом політичної відповідальності. Так як виборці одразу побачать, хто із політиків заробляє на ресурсах громади. І, хто такі заробітки колег підтримує голосуванням.
Після суду Урбанський переможно розповідає, що всі премії перераховує хворим дітям та пораненим учасникам АТО. Хоча, мабуть, якби депутати жили по Закону і АТО б в Україні не було
Однією із подібних гучних справ за новим антикорупційним законом можна пригадати справу Олени Зикової, першого заступника міського голови Фастова, що на Київщині. В січні цього року тамтешній суд за протоколом Нацагентства з питань запобігання корупції визнав винною Зикову через те, що остання будучи депутатом міської ради не попередила сесію про конфлікт інтересів та проголосувала разом з іншими депутатами за призначення собі рангу, надбавок, матеріальної допомоги та відповідного преміювання вже на посаді віце-мера. За рішенням Фастіського міськрайонного суду Олена Зикова отримала штраф у сумі 6,8 гривень.
Правомірність наведеного рішення згодом було підтверджене в Апеляційному суді Київщини. І тепер є велика вірогідність, що весь депутатський корпус Фастова буде рахуватися із антикорупційним законом. А значить вчасно інформувати колег та громаду про те, де чий приватний інтерес закладений в проектах рішень міської ради.
В Одесі ж, суддя Іванов дійшов протилежного висновку. Мовляв, надбавки та премії Урбанському – це не приватний інтерес, а реалізація законів України щодо діяльності посадових осіб, що про надбавки і так всі знали. Тому не треба було заявляти про конфлікт інтересів. Хоча таким чином можна обґрунтувати будь-що. Наприклад, земельна ділянка для сестри депутата – законодавча реалізація права громадянина на землю, про яку всі знають. Зменшення податків для фірми дружини депутата – законодавча реалізація права на підприємницьку діяльність, про яку всі знають і т.д.
Як швидко місцеві ради очистяться від корупції тепер залежить від суддів. В тому числі, і від Віктора Іванова
Закон “Про засади запобігання корупції”, покликаний зменшити рівень корупції в тому числі в стінах органів місцевого самоврядування, де депутати полюбляють ділити власність громад на свою користь. Публічне оголошення про конфлікт інтересів – це важлива політична складова у протидії політичній корупції. Адже, якщо депутат часто буде оголошувати перед колегами та перед медіа про приватні інтереси в проектах рішень місцевої ради, то швидко втратить підтримку виборців. Якщо ж буде ховати такі інтереси, то рано чи пізно після викриття отримає штраф та попаде в реєстр корупціонерів. Тому Всеукраїнський рух проти політичної корупції “Під контролем” закликає суди більш відповідально підходити до прийняття рішень у корупційних справах. Бо ж не для того приймалися антикорупційні закони, щоб тепер судді їх нівелювали.
Для довідки: за останні три місяці згідно інформації обласної ради Анатолій Урбанський отримав із бюджету на руки 38,8 тисяч гривень з вирахуванням податків. При чому політик походить з дуже впливової родини в регіоні. Батько Ігор Урбанський в свій час був народним депутатом від соціалістів і заступник міністра транспорту за часів Миколи Рудьковського і Йосипа Вінського. Брат Олександр Урбанський на останніх виборах до парламенту пройшов від партії Тігіпка, нині член фракції “БПП”. Всі Урбанські представники бізнесу морських перевезень. Голова Одеської ради задекларував 25 мільйонів гривень статків станом на 2015 рік.
